Terms of Service - Master agreement

Terms
As a web solutions provider, Netserve Consultants ltd and Live Networks Ltd offers its customers the means to acquire and disseminate a wealth of public, private, commercial and non-commercial information. Live Networks Ltd also wants its customers to be fully informed of their rights and obligations and those of Live Networks Ltd in connection with their use of the Internet.

When customers disseminate information through the Internet, they also must keep in mind that Live Networks Ltd does not review, edit, censor or take responsibility for any information its customers may create.
This places on customers what will be, for most, an unfamiliar responsibility. When users place information on the Internet, they have the same liability as other authors for copyright infringement, defamation and other harmful speech.

For these reasons, customers violate Live Networks Ltd policy and the Hosting Agreement when they, their affiliates or subsidiaries engage in the following activities:

Spamming
Unsolicited, commercial mass e-mailing (known as "spamming") is a strongly disfavored practice among Internet users and service providers.
It is particularly harmful not only because of its negative impact on consumer attitudes toward Live Networks Ltd, but also because it can overload Live Networks Ltd's equipment and disrupt service to our customers.
For more information about Internet Abuse and Live Networks Ltd's policy concerning these issues.
Illegal/Unauthorized Access to Other Computers or Networks
The illegal or unauthorized accessing (often known as "hacking" or "cracking") of computers or networks carries potential civil and criminal penalties under both federal laws and the laws of most states.

Other Activities
Whether lawful or unlawful, that Live Networks Ltd determines to be harmful to its customers, operations or reputation, including any activities that restrict or inhibit any other user from using and enjoying the service or the Internet.
Please be aware that Live Networks Ltd reserves the right to cancel any account we find in excessive violation of any of the above activities.
Indemnification

Customer agrees that it shall defend, indemnify, save and hold Live Networks Ltd harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Live Networks Ltd, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns.

Customer agrees to defend, indemnify and hold harmless Live Networks Ltd against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Live Networks Ltd' server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from Live Networks Ltd' server.

Customers are responsible for accepting the terms and conditions of the registry relevant to their domain name (copies for relevant registries are available on request or via this site) and for maintaining their domain names. This includes accepting that domain names are registered for a period of time and must be renewed and paid for by the in advance of the expiry date. Customers must be aware of the expiry date of their domain name.

While we make every effort to provide reminders via email it is the customers responsibility to know and act upon the expiry date of their domain names.

Customers should on completion of their registration or renewal request ensure that the domain registration or renewal has been completed for the required period of time and that the ownership details of the domain name are correct using a whois report. It may not be possible or costly to correct mistakes made at the time of registration so we urge all customers to verify their registry data 24 hours after registration or renewal.

Our registration system is dependant on the global whois service which can be up to 24 hours out of date. In some cases it is possible for domains to have been registered by third party prior to customers sending their registration request.

In instances where we are unable to register or renew a domain name for whatever reason a full refund of the registration / renewal fee will be given. Customers should ensure that their domain name has been registered /renewed fully before embarking on any advertising or promotion using their domain name.
